My Story
This website is operated by an Injured Worker (IW) to expose the bureaucratic elites and their special interests in Sacramento that seek to profit from the misery of IWs. These "vile, conniving and despicable" souls support a system dedicated to corporate greed and the protection of corrupt profits. For proof, simply read on.
Mission statement: Not one more needless death of an injured worker to protect corporate insurance profits and industry corruption. We are busy helping to clean up the workers' comp mess by empowering injured workers to (1) hold insurance companies accountable and (2) the bureaucrats charged with overseeing this corruption. Welcome to www.MyStateFundStory.com operated as a public service to others, by myself, Larry Nign, an injured worker (IW). It is my deepest belief that we, as a group, can prevent unneccessary pain and suffering of other IWs by sharing my story concerning the State Compensation Insurance Fund, State Fund. The State Fund (SCIF) collects money from over 265,000 employers in the State of California to provide workers' compensation insurance. In fact, SCIF has been described as a monopoly by industry observers. The State Fund is run by California public employees but behaves as if it were a private for profit insurance company. This story chronicles my battle with the State Fund, and has even been made into a documentary called "Almost Broken." My Story spans from my injury in 1989, through State Fund's crimes in '97, and onward to present day with the continued cover-up by State Officials. In an effort to make it concise and easy to read, I've split the story into chapters: •The Injury starts us in 1989. •The Crimes details the acts which State Fund took to deny me a settlement. •The Investigation covers the Los Angeles D.A.'s investigation into State Fund's crimes. •The Appellate Decision begins with a decision being handed down, and ends with the L.A. D.A.'s refusal to obey it. •The Last Attorney begins with the last acts of Attorney Marsili and ends with the creation of this website. •The Recent Events tells what has happened in 2004 so far. Debunking the myths created by the insurance industry
California employers are led to believe that malingering workers are "cheating" workers compensation to the tune of $1 to $3 Billion dollars a year (a myth debunked by several credible newspaper stories). In fact, California work comp fraud by claimants may amount to only one or two percent of all work comp claims filed. MYTH: Work comp frauds and cheats "pick the pockets of employers." FACT: Work comp claims are paid out of insurance company profits, not premiums. State Fund (SCIF) profits are nearly a billion dollars annually. MYTH: Work comp fraud is widespread and requires a "crack down". FACT: Prosecuting attorneys continue to burn "small fry" cheats to enrage the public at large while massive insurance fraud by the companies themselves goes undetected, unreported, and not prosecuted. KFSN-TV, Fresno, reports Califonia Highway Patrol work comp fraud unit going after "small fry" violators; a patrolman and a dispatcher. Unit was started after the infamous "Chief's Disease" debacle when senior officers were getting excessive work comp early retirements for dubious injuries and taking lucrative security jobs after retiring. Lt Governor John Garamendi sent a letter to Governor Schwarzenegger Regarding the signing of an executive order to reduce state workers wages. In the letter the Lt Governor discusses how hard it would be to try and take care of a family on $262.00 per week and how it is “our duty, as elected officials of this great state, to find solutions to the many challenging problems” Here is my question; my family has had to live on less the $300 a week for years because of the corruption in our workers comp system. I have meet Mr. Garamendi when he was the insurance commissioner. As commissioner he was almost powerless to be of any help. Now that he is the Lt Governor he looks like he really cares about our families. Will he be willing to see that my family finally receives the justice that is long over due? As a public service I will keep you updated so you will be able to see if Lt. Governor will be able to solve this problem.
Notice to Public Employees
I would like any state employee to contact me if they have any knowledge of a rumor thatGovernor Schwarzenegger is puttingpressure on state agencies to maximize their cash intake from the public and to actively recruit from the public sector. If this rumor turns out to be true, and state agencies are told to get more money fromthe public, then something is very wrong. State government has the sole purpose to serve the public and NOT try and make money off the public. Also there should be absolutely no recruiting. If there is so little money and the state is in a budget crisis, then the governor should not be pushing to grow the state government and place even more burden on California tax payers. If you are a public employee and have information that members of the public are being mistreated or abused by someone in your department or agency or that you are being abused by a supervisor and are afraid of retaliation from higher up, you can contact me anonymously if you like .In doing so it shows that you care about the public and how people are treated in the work place. It would be great if you could contact me and express your concerns about your department or agency. Maybe you could even make your complain on an agency letter head. This would eliminate any possible suspicion that the emails might have been fabricated by myself. Also letters as opposed to emails look a lot better posted on my website. Also if you are a teacher, support staff or student, please feel free to contact me if there is any thing I can do to help get real funding for our schools. This also goes for anyone in Health and Human Services. If I can help with my website please let me know. I will do what I can to help. I have not been awarded a grant, and my family lives on a very tight budget so I can not afford any advertising for my website so it is going to have to be word of mouth.
