This document shows how daring some people at State Fund are. Below you'll read State Fund's Assistant Chief Counsel, Charles W. Savage, do his best to mislead California Senator Richard Alarcon.

Mr. Savage states: "The claim was denied by State Fund on the basis that the injury was not work related."
In Reality: State Fund accepted the claim and paid disability benefits for nearly 2 1/2 years. See items 4 through 6 of State Fund's own Statement of Facts.

Mr. Savage stated that I made allegations to the Los Angeles Grand Jury.
In Reality: I never went before the Grand Jury.

Mr. Savage states: "Those allegations were thoroughly reviewed and dismissed by the District Attorney's Office."
In Reality: The District Attorney did thoroughly review the evidence. And after a lengthy investigation of myself and my evidence by the DOI, the D.A. found cause to execute a search warrant on a State Fund office, and went through several hearings attempting to acquire the further evidence of State Fund's crimes. The D.A. even went to a Grand Jury and, as I was told, the D.A. was given a green light to go forward with the prosecution of State Fund's attorney. The reason why the four felony charges were dropped is only truly known by those who worked at the Workers' Comp. Fraud Unit.

Mr. Savage states: "While Mr. Nign may indeed have serious health problems, his claim that they were work related was seriously examined by our staff as well as physicians certified in pulmonary medicine and found to be invalid."
In Reality: What Mr. Savage failed to mention was that State Fund had accepted the claim and was paying on it. And that only by ignoring evidence such as the Treating Physician's reports and even their own Jobsite Report, could their staff ever be convinced that I was not injured at work.

You'll notice that instead of trying to explain why they stopped disabilty payments, State Fund now wants to believe that the claim was never accepted to begin with. Once again State Fund has painted a nice picture in which everything is good and proper, until you actually compare it to what has really happened.

Why is an injured firefighter forced to live in excruciating pain?

State Compensation Insurance Fund, a government insurance carrier, continues to deny repeated requests for an FDA approved Pro Disk (Artificial Disk) replacement for this injured firefighter. The Doctor's request to perform an FDA approved spinal surgery was denied because it is NOT ALLOWED by the ACOEM guidelines.

In 2004 the California legislature passed SB899 and the Governor signed it into law. SB899 now re-defines "Cure and relieve" to only be treated in accordance with ACOEM guidelines.

Why did the state legislature stop allowing the Treating Doctor to have the final say on how the injured worker should be treated? After all the TREATING DOCTOR would have the best idea on what level of care an injured worker will be needed to give him the very best chance to heal and return to the job.

I complied with the senators’ request and wrote to the insurance commissioner as a public service. To date I have not received any reply from the commissioner, because I believe the commissioner is being kept in the dark so he will have no knowledge that SCIF, a state agency is allowed to save money on my injury claim, by violating state and federal laws.
