This is a transcription of State Fund's on-site investigation report confirming the work conditions under which I was exposed. This report was sent to only one of the doctors whom I saw. But was withheld from the rest of the doctors, including the AME. In addition, this report was withheld from me until early May 1997, eight years after it was written. I was at Racecraft for one hour on Thursday, 3/24, and was given a complete tour and was able to observe their operation. This is a family business, run by the Father, Kenneth, and two sons, Larry and a younger brother. They are engaged in manufacturing plastic parts for industry, and the parts are made in a huge machine called a Plamco vacuum former. The machine is made to form pieces of plastic measuring 36"x48". Above the machine is a three phase ceiling fan measuring 48"x48". The sheet of platic is inserted into the vacuum forming machine, and the machine pushes into the sheet, remaining for a few second, and then lifts away having formed the sheet into the desired shape. Fumes are emitter when this occurs though the ceiling fan is designed to prevent this. In fact there is a visible cloud coming off the front of the machine near the operator. The plastic being heated and formed contains the chemicals listed in the history and physical report, benzene, phenol and phosgene, all of which can result in respiratory irritation, especially phosgene.

Also of possible interest is the glue that is used in their processes, IPS Weldon 1707, for use on Acrylonitrile Butadiene Styrene Plastic. Other members of Larry Nighs family have worked around the same places with no ill effect, at least not yet. It appears Larry is more sensitive to there exposure. It appears advisable that persons working near the vacuum forming machine be required to wear proper respiratory protection to avoid possibile injury, which would be cumulative rather than acute.

A fire fighter's story of pain and suffering, in his own words.
Why is an injured firefighter forced to live in excruciating pain? State Compensation Insurance Fund, a government insurance carrier, continues to deny repeated requests for an FDA approved Pro Disk (Artificial Disk) replacement for this injured firefighter. The Doctor's request to perform an FDA approved spinal surgery was denied because it is NOT ALLOWED by the ACOEM guidelines. In 2004 the California legislature passed SB899 and the Governor signed it into law. SB899 now re-defines "Cure and relieve" to only be treated in accordance with ACOEM guidelines. Why did the state legislature stop allowing the Treating Doctor to have the final say on how the injured worker should be treated? After all the TREATING DOCTOR would have the best idea on what level of care an injured worker will be needed to give him the very best chance to heal and return to the job.
I complied with the senators’ request and wrote to the insurance commissioner as a public service. To date I have not received any reply from the commissioner, because I believe the commissioner is being kept in the dark so he will have no knowledge that SCIF, a state agency is allowed to save money on my injury claim, by violating state and federal laws.
